Specific confidentiality terms may be outlined in a separate Non-Disclosure Agreement (NDA).

5. AI and Machine Learning Disclaimers

5.1 Nature of AI Solutions

AI and machine learning systems, including large language models, produce probabilistic outputs. While we strive for accuracy and reliability, AI-generated outputs may contain errors, biases, or inaccuracies. Clients are responsible for validating AI outputs for their specific use cases.

5.2 Third-Party AI Services

Our solutions may incorporate third-party AI models and services (e.g., OpenAI, Anthropic, Google). These services are subject to their own terms and conditions. eval.team is not responsible for changes, outages, or limitations imposed by third-party AI providers.

5.3 Responsible AI

We follow responsible AI practices and build solutions with appropriate guardrails. However, clients are ultimately responsible for ensuring that AI solutions deployed in their products and operations comply with applicable laws, industry regulations, and ethical standards.

6. Payment Terms

Payment terms, including rates, milestones, and invoicing schedules, are defined in individual project agreements. Unless otherwise agreed, invoices are due within 30 days of issuance. Late payments may incur interest at the rate of 1.5% per month. eval.team reserves the right to suspend work on overdue accounts.

7. Warranties and Disclaimers

7.1 Service Warranty

We warrant that our services will be performed in a professional and workmanlike manner consistent with generally accepted industry standards. If any deliverable fails to meet the specifications agreed upon in the project agreement, we will re-perform the services at no additional cost within a reasonable time.

7.2 Website Disclaimer

Our website and its content are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not warrant that the website will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by applicable law, eval.team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or related to our services or website. Our total liability for any claim shall not exceed the total fees paid by you for the specific services giving rise to the claim during the 12 months preceding the event.

Either party may terminate a service engagement as outlined in the applicable project agreement. We reserve the right to suspend or terminate access to our website at any time without notice for any violation of these Terms. Upon termination, all provisions that should survive termination (including confidentiality, intellectual property, and limitation of liability) shall continue in effect.

10. Indemnification

You agree to indemnify, defend, and hold harmless eval.team, its officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of our website, your violation of these Terms, or your infringement of any third-party rights.
